Welcome to the website of Armour Secure Insurance S.A. de C.V. (hereinafter “ArmSec”), a company dedicated to providing title insurance products and escrow services in Mexico.

By accessing or using this website (the “Site”) and the products and services offered (the “Services”), you agree to these Terms and Conditions, as well as our Privacy Notice.

2. Acceptance of the Terms

Access to and use of the Site constitutes full and unconditional acceptance of these Terms and Conditions, in accordance with the provisions of the Mexican Commercial Code and the Federal Civil Code.

If you do not agree with these Terms, you must refrain from using the Site and the Products and Services.

3. Nature of the Products and Services

3.1 Title Insurance

ArmSec provides analysis and insurance services for real estate titles to protect interested parties against potential defects in ownership, hidden liens, pending litigation, or other legal risks associated with real property.

The issuance of policies is subject to:

  • Prior review of registry and legal background.
  • Risk assessment.
  • Express acceptance through the corresponding contract or insurance policy.

3.2 Escrow Services

ArmSec acts as a neutral third party to:

  • Receive funds and/or documents.
  • Safeguard them in accordance with contractual instructions.
  • Release them once the agreed conditions have been fulfilled.

Escrow services shall be governed by:

  • A specific agreement executed by the parties.
  • Written and verifiable instructions.
  • Applicable commercial regulations.

Armour Secure does not act as legal advisor, public notary, or representative of any party.

4. Permitted Use of the Site

The User agrees to:

  • Use the Site in accordance with Mexican law.
  • Provide truthful, complete, and up-to-date information.
  • Refrain from performing acts that infringe upon third-party rights.
  • Not attempt unauthorized access to systems or databases.

Any fraudulent, unlawful, or security-compromising use of the Site is strictly prohibited.

5. Registration and Security

Where access to certain Products or Services requires registration:

  • The User is responsible for maintaining the confidentiality of their credentials.
  • ArmSec may suspend or cancel accounts in cases of misuse.

6. Fees and Payments

Applicable fees will be disclosed prior to contracting.

Payments must be made through authorized methods.
In the event of non-payment, ArmSec may suspend the corresponding service.

7. Personal Data Protection

The processing of personal data shall be carried out in accordance with:

The Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP).

Users may exercise their ARCO Rights (Access, Rectification, Cancellation, and Objection) in accordance with the Privacy Notice available on the Site.

8. Intellectual Property

All Site content (including trademarks, logos, texts, software, design, and databases) is the property of ArmSec and is protected by the Federal Law for the Protection of Industrial Property and the Federal Copyright Law.

Reproduction without prior written authorization is prohibited.

9. Limitation of Liability

ArmSec:

  • Does not guarantee that the Site will be free from errors or interruptions.
  • Shall not be liable for indirect, incidental, or consequential damages arising from the use of the Site.

Liability arising from contracted Products or Services shall be strictly limited to the provisions set forth in the corresponding insurance policy or escrow agreement.

10. Regulatory Compliance and Anti-Money Laundering

ArmSec may require additional documentation to comply with regulations concerning:

  • Prevention of Operations with Illicitly Obtained Resources (Anti-Money Laundering).
  • Customer identification (KYC).
  • Applicable financial regulations.

Failure to provide such information may result in suspension of the product or service.

11. Modifications

ArmSec may modify these Terms at any time.
Modifications shall take effect upon publication on the Site.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States.

For the interpretation and enforcement of these Terms, the parties submit to the jurisdiction of the competent courts of Mexico City, expressly waiving any other jurisdiction that may apply based on their present or future domicile.
